These Terms & Conditions apply to all services provided by Rise Visual Media (“Rise,” “we,” “our,” or “us”). By booking services, using our website, or engaging with our team, you agree to these terms.
1. Services
Rise Visual Media provides professional photography, videography, drone services, and visual marketing services for real estate professionals and businesses.
Service delivery is dependent on accurate information, access, and readiness provided by the client.
2. Ownership, Copyright & Usage Rights
• All media created by Rise Visual Media remains the sole and exclusive property of Rise Visual Media, unless otherwise agreed to in writing
• Clients are granted a limited, non-transferable license to use delivered media only for the agreed-upon purpose after full payment is received
• AI & Repurposing Restriction
Clients may not upload, modify, remix, repurpose, train, or use Rise-created media with artificial intelligence tools or systems without prior written consent
• Rise Visual Media retains the unrestricted right to:
Use any created media for marketing, promotion, portfolio, advertising, or education
License or sell the media to third parties at our discretion
No exclusivity is granted unless explicitly stated in a signed agreement.
3. Payment Terms
• Payment is due in full before delivery of any media or assets, unless otherwise agreed to in writing
• Rise Visual Media reserves the right to withhold delivery, revoke access, or remove hosted content until payment is received
• Usage rights are not granted until payment has cleared
• Late or unpaid invoices may result in service suspension or refusal of future bookings
• Any chargeback or payment dispute filed after delivery will immediately revoke all usage rights
• All payments are non-refundable once services are rendered or resources are allocated
4. Cancellations, Reschedules & Client Readiness
Same-Day Cancellations
Appointments canceled on the same calendar day as the scheduled service may be subject to up to 100% of the appointment cost
Cancellations Within 24 Hours
Appointments canceled within 24 hours of the scheduled start time may be subject to a cancellation fee of up to 50%
Reschedules Due to Client Error
Additional fees may apply if delays or reschedules occur due to:
• Client not being ready at the scheduled time
• Property not accessible
• Client’s customer or homeowner not prepared
• Failure to confirm readiness in advance
Rise Visual Media is not responsible for delays caused by third parties.
5. Client Responsibilities
Clients agree to:
• Ensure all properties, subjects, and decision-makers are ready at the scheduled time
• Secure all permissions, access, and approvals
• Verify accuracy of listing details and deliverables prior to the appointment
Additional charges may apply for return visits or extended time caused by lack of readiness.
6. Drone & Regulatory Compliance
• Drone services are subject to FAA regulations, weather conditions, airspace restrictions, and approval timelines
• Rise Visual Media is not liable for delays or inability to fly due to safety or regulatory limitations
7. Limitation of Liability
• Rise Visual Media is not liable for indirect, incidental, or consequential damages
• Liability is limited to the amount paid for the specific service provided
• Rise Visual Media is not responsible for missed listings, marketing outcomes, platform errors, or third-party system failures
8. SMS Terms & Conditions
If you opt in to receive SMS communications, the following applies:

Phone numbers and consent data will not be shared with third parties for marketing purposes.

Billing notifications
Customer care
Message Frequency
You may receive up to 4 messages per month. Message frequency may vary based on your activity with us.

9. Force Majeure
Rise Visual Media is not responsible for delays or failures caused by events beyond reasonable control, including weather, illness, equipment failure, power outages, or government restrictions.
10. Changes to These Terms
Rise Visual Media may update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of the updated terms.
11. Governing Law & Venue
These Terms & Conditions are governed by and construed in accordance with the laws of the State of Connecticut, without regard to conflict of law principles.
Any legal action, claim, or proceeding arising out of or related to these Terms or services provided by Rise Visual Media shall be brought exclusively in the state or federal courts located within the State of Connecticut, and the parties consent to personal jurisdiction and venue in those courts.
